Terms & Conditions of Sale

All Products offered for sale on the Site are original creative works by Lorraine Medici. Three categories of Products are offered:

(a) Original Artwork. One-of-a-kind physical paintings, hand-created by the Artist. Each original is unique; once sold, it cannot be replaced.

(b) Fine Art Prints. Reproductions of original artwork, produced and shipped through a third-party print-on-demand fulfillment partner. Prints are made to order and are not held in inventory.

(c) Digital Downloads. High-resolution digital files of artwork, delivered electronically for the buyer's personal use under the license described in Section 7.

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion, including but not limited to circumstances involving suspected fraud, pricing errors, product unavailability, or inability to ship to your location. If an order is declined after payment, you will receive a full refund.

All prices are listed in USD and do not include applicable taxes, duties, or shipping charges unless expressly stated. You are responsible for any customs duties, import taxes, or fees imposed by your country of delivery.

Payment is processed securely through Squarespace Commerce and its authorized payment processors. We do not store your full payment card information. By submitting payment, you represent that you are authorized to use the payment method provided.

Item descriptionOriginal paintings are packaged and shipped by the Artist. Processing time is typically [3–7 business days], with delivery time varying by destination. You will receive a tracking number once your order ships.

Item descriptionFine art prints are produced and shipped on demand by our third-party fulfillment partner, Prodigi, which operates a global network of print facilities. Production time is typically 2–5 business days in addition to shipping time. Tracking information will be provided once your print ships.

We are not responsible for delays caused by the fulfillment partner, the shipping carrier, customs processing, or events outside our reasonable control.

Original Artwork: Due to the unique nature of original paintings, all sales are final unless the artwork arrives damaged. If your original arrives damaged, you must notify us within [7 days] of delivery with photographs of the damage and the packaging. We will arrange either a replacement (where possible) or a refund at our discretion.

Fine Art Prints: Prints are made to order and cannot be returned for change of mind. If your print arrives damaged or defective, contact us within 7 days of delivery with photographs, and we will arrange a replacement at no charge.

Digital Downloads: All sales of digital downloads are final and non-refundable. Because digital files cannot be "returned" once delivered, no refunds will be issued except where required by applicable law.

When you purchase a digital download, you are purchasing a limited license — not the artwork itself. The Artist retains all copyright and intellectual property rights in the underlying work.

You may:

• Download the file for your personal use

• Print the file for personal display in your home or private space

• Make a reasonable number of backup copies for your own use

You may not:

• Resell, redistribute, sublicense, or share the file with any third party

• Use the file for any commercial purpose, including but not limited to merchandise, marketing materials, or print-for-sale

• Modify, alter, or create derivative works from the file

• Claim authorship of, or remove attribution from, the artwork

• Upload the file to any public website, social media account presenting it as your own work, NFT marketplace, stock image service, or AI training dataset

This license is granted to you, the original purchaser, and is non-transferable. Violation of these terms automatically terminates the license and may result in legal action.

All artwork, images, text, and content on the Site are the exclusive property of Lorraine Medici and are protected by copyright laws of the United States and international treaties. Purchase of any Product does not transfer copyright or any reproduction rights to the buyer, except as expressly granted under Section 7.

Unauthorized reproduction, distribution, or commercial use of the Artist's work is prohibited and will be pursued to the full extent of the law.

Colors as displayed on your screen may differ slightly from the actual artwork or print due to monitor calibration, lighting, and the natural variability of physical media. Such variations are normal and do not constitute a defect or grounds for return.

For original paintings, slight differences between the listing photograph and the physical artwork may exist due to lighting, photography, and the inherent characteristics of paint, canvas, and finish.

To the fullest extent permitted by law, Lorraine Medici's total liability arising from or related to any purchase shall not exceed the amount you paid for the Product giving rise to the claim. In no event shall we be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, or emotional distress.

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.

These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in KENT County, MICHIGAN, and you consent to the jurisdiction of those courts.

We may update these Terms at any time. The version in effect at the time of your purchase governs that transaction. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
